Minnesota Bail Reform Update
Minnesota lawmakers considered a major proposal in 2026 that would have amended the state constitution to prohibit monetary bail and move toward a pretrial-release system based largely on risk and detention eligibility rather than money.
The proposal was discussed in a Minnesota House committee in April and stated plainly that “the use of monetary bail is prohibited.” Had it advanced and been approved by voters, it would have significantly affected Minnesota’s commercial surety bail industry.
The good news is that the proposal did not make the November 3, 2026 statewide ballot. Minnesota has not eliminated monetary bail, and voters will not be deciding that issue this November.
We are also very encouraged to see Minnesota bail agents organizing and coming together. They have selected excellent leadership and are moving forward with the formation of the Minnesota Bail Agents Association. We are proud to support their efforts and plan to attend their first meeting in November. We were also impressed during their first board meeting today which we attended electronically.
We are also pleased to report that national bail associations are supporting their efforts as well. This is exactly what our industry needs…agents, associations and sureties working together and standing together.
